Summary of Complaint:

Eduardo Cojuangco, Jr. and thirty-four (34) other defendants including the Marcos spouses are impleaded in this case as they are charged of having created, capitalized and/or funded the defendant-corporations with the use of the coconut levy funds for their personal benefit.  Among such corporations were the Philippine Coconut Producers Federations, Inc. (COCOFED), Coconut Investment Company (CIC); COCOFED Marketing Corporation (COCOMARK), United Coconut Planters Life Assurance Corporation (COCOLIFE).

Status:

RP’s Motion for Partial Summary Judgment dated 8 September 2002 is pending consideration of the Sandiganbayan although the same has already been submitted for resolution as of March 2005.  In a Joint Resolution promulgated on 2 June 2016 the Court denied the Motion for Partial Summary Judgment and/or Judgment on the Pleadings filed by the Plaintiff in Civil Case No. 0033 B as well as the Motion for Partial Summary Judgment in Civil Case No. 0033 D. RP filed a Motion for Reconsideration (of the Joint Resolution dated 2 June 2016 and 8 July 2016 to which Defendants Conjuangco and Ursua filed their respective Opposition.  In a Joint Resolution promulgated on 9 May 2017 the court denied the Motions for Reconsideration filed by the Republic in Civil Case No. 0033 B (and Civil Case No. 0033-D). The case was elevated to the Supreme Court on 17 July 2017 under GR No. 232449.

Meanwhile, ECJ filed a Motion to Dismiss dated 30 April 2015 on the alleged ground that his right to a speedy disposition of the case has been violated.  RP’s opposition was filed on 18 May 2015.  ECJ submitted a Reply dated 29 May 2015. In a Joint Resolution promulgated on 18 April 2017, the Sandiganbayan denied the Motion to Dismiss filed by ECJ in Civil Case Nos. 0033-B, 0033-D and 0033-H.

The Preliminary Conference set on 16 February 2017 was cancelled and re-set to 18 April 2017.

ECJ filed a Manifestation with Motion to Include Civil Cases Nos. 0033-B, 0033-C, 0033-D, 0033-E, 0033-G and 0033-H in the Court Calendar for Trial dated Feb 2, 2018.

For RP v. SB 2nd Div, ECJ, et al., G.R. No. 232449, and RP vs. SB 2nd Division, ECH, COCOFED, et al. G. R. No. 232423, the SC in a Resolution dated August 22, 2018 ordered to CONSOLIDATE GR No. 232449 with GR No. 232423 assigned to the Third Division, considering that both cases assail the same SB Joint Resolution in Civil Case Nos. 0033-B and 0033-D and to TRANSFER GR No. 232449 to the Third Division, where the Member-in-Charge of GR No. 232423, the lower-numbered case, belongs.

Notice of Death dated May 10, 2019 – Attached is the death certificate of Danilo S. Ursua  who died on August 10, 2018 in Makati City.

Remarks: The court set the case for pre-trial conference on 16 March 2000.  It was  in pre-trial stage when RP filed its Motion for Partial Summary Judgement dated 8 September 2002. Said motion is pending resolution by the Sandiganbayan to this date.
