Summary of Complaint: The case was dismissed by the Sandiganbayan against defendants Cesar Zalamea and Don Ferry in a Resolution dated 22 December 2010. RP elevated the case before the Supreme Court under docket number GR No. 195837 on 16 March 2011.

On the other hand, the case was likewise dismissed against Lucio Tan and the rest of the defendants in a Decision dated 11 June 2012 despite pending incidents in the Sandiganbayan and the Supreme Court (G.R. Nos. 195837[1], 198221[2], 198974[3]).  With the denial of RP’s Motion for Reconsideration on 26 September 2012, the case was elevated to the Supreme Court in a Petition for Review on 8 October 2012 under G.R. No. 203592.

RP filed its consolidated Memorandum on 2 February 2015. Defendants’ have already filed their respective memoranda.

In the above-mentioned consolidated cases, the Supreme Court issued a (Show Cause) Resolution dated 15 November 2016 requiring: (a) Imelda R. Marcos (IRM) and Irene M. Araneta to SHOW CAUSE why they should not be disciplinarily dealt with for not filing their memorandum as required in its 23 September 2014 Resolution, (b) comply with said Resolution, and (c) provide the name and address of their new counsel.  Also, respondents Don Ferry and IRM were required to SHOW CAUSE why they should not be disciplinarily dealt with for not filing their comment in GR NO. 203592 as required in its 3 December 2012 Resolution, and comply with said resolution by filing the required memorandum above-stated.

In a Resolution dated 10 January 2017, the Court noted the 1) Explanation dated 5 December 2016 of the respondents Heirs of Panfilo Domingo for failure to file a Comment on the Manifestation with Urgent Motion filed by PCGG; 2) Comment dated 5 December 2016 3) Manifestation with comment dated 5 December 2016 filed by respondent Heirs of Gregorio Licaros with explanation also for failure to file the required Comment and 3) Compliance with Manifestation dated 29 November 2016 filed by the Estate of FEM.

–          DIRECT the Process Servicing Unit to RESEND the reso dated 11/15/16 together with this resolution to Atty Ernesto Vinluan Perez, counsel for resp. Heirs of Gregorio Licaros

–          DIRECT the petitioner to PROVIDE the current address of Atty Norberto B. Tria counsel for resp. Don Ferry within 10 days from notice

–          DIRECT Atty Robert Sison to PROVIDE the current address of Irene R. Marcos-Araneta within 10 days, Irene Araneta appearing from the records that did not filed the memorandum required in the reso dated Sept 23, 2014.

Respondents Lucio C. Tan, et al. filed a Motion to Resolve Pursuant to Section 15 (1), (2) and (4), Article VIII of the Constitution, as regards the Petition for Review dated October 25, 2012 filed by the Republic praying to nullify the Decision of the Sandiganbayan dated June 11, 2012 and its Resolution dated September 26, 2012 dismissing the Complaint filed by RP in Civil Case No. 0005.

  • Atty Sison, counsel for resp. IRM failed to comply with the reso dated April 24, 2018, the Court resolved to (a) IMPOSE upon Atty Sison a FINE of P1,000.00 payable to the Court within 10 days or a penalty of imprisonment of 5 days if said fine is not paid within said period and (b) REQUIRE Atty Sison to COMPLY with the resolution of April 24, 2018 in GR No. 203592, also within 10 days from notice
  • Resolutions dated February 20, 2018 and April 24, 2,018 addressed to Atty. Ernesto Vinluan Perez were returned unserved, the Court resolve to DIRECT the Process Servicing Unit to SEND the resolution directly to the heirs of Gregorio Licaros and (b) DIRECT resp. Heirs of Gregorio Licaros to PROVIDE the Court with the current address of their counsel within 10 days  from notice.
