Summary of Complaint: In a Resolution dated 25 October 2012, the Motion to Dismiss dated 2 April 2012 filed by Ferdinand Marcos, Jr. was granted by the Sandiganbayan. A Motion for Reconsideration was filed by OSG on 23 November 2012. Motion for Partial Reconsideration was also filed by the Heirs of Roman Cruz for lack of jurisdiction.
- RP’s Motion for Reconsideration was denied, hence, RP elevated the case before the Supreme Court on 3 January 2014 under R. NO. 210015. Reply was already filed by RP on 29 September 2014 in response to the Estate’s Comment.
On the other hand, the Heirs of Roman Cruz also filed a Motion to Dismiss dated 28 November 2012 which was denied in a Resolution dated 29 May 2013.
Another Motion to Dismiss dated 10 February 2014 was filed by the Heirs of Roman Cruz for failure of plaintiff to appear during pre-trial but this was denied in a Resolution promulgated on 2 June 2014.
The Heirs are negotiating for a compromise settlement for the dropping of this case, Civil Case No. 0034 and Civil Case No. 0014 against them (as Heirs of Roman Cruz who were substituted thereon. In the meantime, hearings in this case are being re-set.
In a Memorandum dated Sept. 13, 2018, the Court said that Respondents Ramon S. Monzon, Generosa Olazo, Cynthia Cheon and Ma. Luisa E. Nograles be dropped as respondents in SB CC 0034.
