Summary of Complaint: Defendant Silverio, Sr. filed his Formal Offer of Evidence dated 21 October 2015. In a Resolution dated 8 December 2015, SB resolved to admit his Exhibits 1-13.
The presentation of the evidence of the Intestate Estate of Pablo Carlos, Jr. is set on January 18 and 19, 2016.
PJ Cabotaje-Tang issued a Disclosure dated August 18, 2016 involving her participation in said case when she was Assistant Solicitor General.
PJ Cabotaje-Tang voluntarily inhibited herself from participating in the case on 5 October 2016 and the records of the case were forwarded to the Judicial Records Division for re-raffle.
In the Order dated 17 January 2017 the Court directs the plaintiff to submit Comment/Opposition to the Notice of Death and Motion for Substitution of Defendant Ricardo Silverio dated 10 January 2017 within 10 days and sets the incidents for hearing on 6 March 2017. The Republic filed the Comment on 1 March 2017. In the Order dated 6 March 2017, defendant was given ten (10) days within which to file his reply and 30 days within which to submit the certified true copy of the death certificate of Ricardo Silverio.
A Motion for Extension of Time to file an entry of appearance, SPA of the proposed substitute defendant Lorna Silverio and Compliance dated 16 March 2017 was filed by defendant’s counsel. Compliance dated 27 March 2017 was filed by defendant’s counsel. On 2 August the Sandiganbayan gave the counsel movant Silverio a fifteen (15) days non-extendible period within which to submit a PSA issued death certificate of Ricardo Silverio and to furnish a copy thereof to the plaintiff who is likewise given the same period within which to file its comment.

In a Resolution dated 29 May 2018, the Court NOTED the “Tender Of Excluded Evidence” dated 9 May 2018, filed by the plaintiff Republic and GRANTED the request that the Affidavit of Rolando C. Gapud dated August 1, 1987, sworn in Hong Kong which forms part of his deposition be attached and made part of the Records of this case.
Defendant Ricardo C. Silverio filed a Motion For Reconsideration (of Resolution dated 31 May 2018) dated 27 June 2018, through counsel, praying that the Hon. Court reconsider the Resolution dated 31 May 2018, and deny plaintiff’s Tender of Excluded Evidence dated 9 May 2018.
In an Order dated 6 July 2018, the “Motion For Reconsideration (of Resolution dated 31 May 2018)” dated 27 June 2018 filed on 29 June 2018, by Atty. Camille Bianca M. Gatmaitan, counsel for the accused, the OSG was given a period of 15 days to file its comment and as prayed for by Atty. Erices John L. Quizon, who appeared counsel for accused Silverio, he was given the same period of 15 days within which to file his reply on the comment/opposition of the prosecution, thereafter, the incident shall be deemed SUBMITTED for resolution.
Resolution promulgated on Feb. 11, 2019:
The Court finds no cogent reason to set aside its Resolution dated May 29, 2018. The subject Motion for Reconsideration is DENIED.
