The Presidential Commission on Good Government (PCGG) thru the Disposal Committee will conduct a sealed public bidding for the disposal of its unserviceable properties and equipment

  1. SUBJECT AND MANNER OF SALE

1.1 The subject of the public bidding are unserviceable properties and equipment listed in Annex “A” hereof with a total Floor Price of EIGHT THOUSAND TWO HUNDRED FOURTEEN PESOS (Php8,214.00);

1.2 The sale shall be through a sealed public bidding in “CASH” on ‘AS-IS, WHERE-IS” basis;

1.3 Interested bidders must bid all of the items;

1.4 The award of the sale shall be subject to the approval of the PCGG Chairman.

  1. BID LETTER AND BID BOND

2.1 On bidding date, Aug. 31, 2021, the bidder must submit the duly accomplished Bid Letter and a Bid Bond equivalent to ten (10%) percent of the bid price, in cash;

2.2 The Bid letter and Bid Bond must be enclosed in a sealed envelope bearing the name of the bidder;

2.3 A bid submitted without the required/acceptable Bid Bond shall be automatically rejected.

  1. BIDDER’S RESPONSIBILITY

3.1 It is the responsibility of the bidder to inspect the items subject of the bidding;

3.2 By submitting its bid, the bidder is deemed to have waived any right it may have to seek and obtain a writ of injunction or of prohibition or a restraining order or any other form of coercive, judicial, administrative or other relief against the PCGG Chairman or any member of the Disposal Committee to prevent, restrain or in any other manner forestall, hinder or render inconvenient the holding of the bidding or re-bidding, including, but not limited to, the negotiation and award of the subject property to the winning bidder, and the transfer of the possession and ownership of such property;

3.3 The bidder is required to submit a duly-signed
Authorization from the person or company he is representing.

  1. PRE-BID CONFERENCE

Pre-bid conference on August 25, 2021 at 10:00 am at the Salonga Room, Ground Floor, IRC Building., No. 82 EDSA, Mandaluyong City. Bidders or its authorized representative can attend personally and/or through video conferencing or webcasting via Zoom.

The Meeting ID will be provided to the bidder prior to the schedule.

  1. SUBMISSION AND OPENING OF BIDS

5.1 All bids must be sealed, addressed and delivered to:

IRC Building, No. 82 EDSA
Mandaluyong City

5.2 Bids should be submitted on August 31, 2021 at 10:00 am., Salonga Room, Ground Floor, IRC Building., No. 82 EDSA, Mandaluyong City personally and/or through video conferencing or webcasting via Zoom.

The Meeting ID will be provided to the bidder prior to the schedule.

5.3 Bids shall be opened at exactly 10:00 a.m. Bidders or their duly authorized representative shall be allowed to attend and witness the proceedings provided they will strictly follow the health safety protocol and/or through video conferencing or webcasting via Zoom;

5.4 PCGG reserves the right in its discretion to reject any and all bids or any part thereof, and to waive any formality or requirements contained therein and will accept the offer it considers as the most advantageous to the Government.

  1. SELECTION CRITERIA

6.1 The highest bidder for the subject property shall be determined on the basis of the bid price;

6.2 In case of a tie, said bidders shall submit new sealed bids within a reasonable time as may be determined by the Disposal Committee. The new bid price, however, shall not be lower than the bid price previously submitted. If any bidder involved in the tie shall fail to submit a new bid, its original bid shall be deemed re-submitted;

6.3 In case of another tie, the same shall be resolved through a toss coin.

  1. AWARD AND EXECUTION OF CONTRACT

    7.1 After the highest bidder is determined, the Disposal Committee shall submit its recommendation to the Chairman for his consideration. In case of approval, a Notice of Award shall be issued to the winning bidder;

    7.2 The awardee shall be given three (3) working days from the date of the receipt of the Notice of Award to pay the purchase price in cash or cashier’s/manager’s check payable to PCGG;

    7.3 The PCGG shall execute the Deed of Sale upon receipt of the payment;

    7.4 Should the awardee fail to pay the purchase price within the prescribed period, the award shall be automatically cancelled and the bid bond forfeited in favor of the PCGG;

    7.5 The winning bidder shall withdraw the awarded items within seven (7) working days upon payment. A storage fee equivalent to ten (10%) percent of the value of the un-withdrawn quantity or P500.00, whichever is higher, shall be charged per day of delay;

    7.6 The winning bidder shall assume all responsibilities and/or obligations, if any, arising from the withdrawal of the properties and shall hold PCGG free from any third-party claim for damages.
